Acceptance of Terms
These Terms of Use of Service (these “Terms”) you are reading are a legally binding agreement between Hargol FoodTech Ltd. (“BiblicalProtein”) and users of this site/application (each a “User” of this “Site”, or “you”).
These Terms should be read in conjunction with BiblicalProtein’s Privacy Policy which constitute an integral part of these Terms.
By accessing or using BiblicalProtein’s Site, you agree that you have read, understood, accept and agree to be bound by these Terms (for the avoidance of doubt, including our Privacy Policy). If you do not agree to these Terms, do not use the Site, as the use of which is subject to the provisions of these Terms.
You may not use the Site and may not accept these Terms if you are a person barred from receiving the Site under the laws of the state in which you are resident or from which you use the Site, including if you are under the legal age of adulthood in the jurisdiction applicable.
We may change these Terms from time to time, in our sole discretion by updating this posting, and these updated Terms shall apply from the moment such change was made. Description of Service
The Site enables online purchases in certain US states of food products based on grasshoppers’ protein.
Rules of Conduct and Usage
You shall use the Site lawfully, for only legal purposes, in compliance with all applicable laws and regulations, local, state, national, federal, or international.
Without derogating from the forgoing, you shall not:
• Post, host, upload, transmit, display or otherwise disseminate any unlawful, infringing, defamatory, libelous obscene, indecent, threatening, offensive or otherwise objectionable material of any kind, including any material that encourages illegal conduct or conduct that may involve legal liability, infringe on another’s intellectual property rights or otherwise violates any applicable local, state, national or international law.
• Use or apply in connection with the Site any spyware or other malicious programs. Do not Upload or transmit (or attempt to upload or transmit) files that contain viruses, Trojan horses, worms, time bombs, corrupted files or data, or any other similar software or programs that may damage the operation of the Site or the systems of other Users of the Site.
• Engage in any crawling, scrapping, or alike activities in connection with the Site. The use of automated systems or software to extract data from this website or application for commercial purposes, is strictly prohibited.
• Create false personas, multiple identities or user accounts, set up an account on behalf of someone other than yourself, or otherwise defraud or impersonate. You shall only provide the Site with information which is truthful, accurate and complete, and you will notify BiblicalProtein promptly of any changes in such information.
User Content
Without derogating from the aforesaid in the personal data and privacy section below, you represent and warrant that you have and will continue to have all required rights to transmit/upload/send/receive otherwise use any content (whether data, text, or any other content) transmitted/uploaded/sent/received/otherwise used by you through the Site (the “User Content”).
It is clarified that BiblicalProtein will not be under any circumstances responsible or liable for any User Content, or any loss or damage incurred in connection thereto.
Account Information
You are required to establish an account on the Site in order to use certain features, such as making a purchase. During the registration process you may need to set a username and password. You should maintain the confidentiality of your login information (including usernames and passwords). You are responsible for the confidentiality of your account and password. Do not share your user/enterprise account or login information, nor let anyone else access it or do anything else that might jeopardize the security of your account, including by ensuring to that you exit from your account at the end of each session. You are fully responsible for all activities that occur under your account or password and for all charges resulting from the use of your account on the Site. In the event you becomes aware of or reasonably suspect any breach of security, including, without limitation any loss, theft, or unauthorized disclosure of your login information or unauthorized access to your account, you must immediately notify us and modify your login information. We are not liable for any loss or damage resulting from your failure to comply with this section.
Personal Data and Privacy
We highly respect your privacy. Please review our Privacy Policy which applies to personal information obtained from or provided by you in the course of accessing/interfacing/using the Site.
Payments
BiblicalProtein will use the payment details provided by you only for purpose for which they were supplied – meaning for charging the purchases made on the Site. BiblicalProtein shall take reasonable steps to ensure that the details of the payment are kept safely, though will not bear any liability for damage or loss caused to the User due to unauthorized access to the payment details provided by the User.
Payment is safely processed through a third party payment processor (a “Payment Processor”) and then paid to us. In the event of credit card fraud or unauthorized use of your account(s) by third parties, most banks and credit card companies bear the risk and cover all the charges resulting from such fraud or misuse, which may sometimes be subject to a deductible, but we cannot assure that. In addition, you agree: (i) that the services of Payment Processors may be used to process transactions; (ii) to review and be bound by the Payment Processor’s terms of use and privacy policy; and (iii) to only provide valid and current information for yourself, and to only use payment details and means that you are fully and legally authorized to use. We are not responsible or liable for any activities or conduct of a Payment Processor, and you agree that you shall have no claim, suit or demand of any kind, and by agreeing to these Terms, hereby irrevocably and completely waive any such claim, suit or demand of any kind, to the extent such may exist or hereafter arise, towards us and any of our managers, directors, officers, shareholders, partners, affiliates, employees, consultants, service providers and/or any other person or entity acting on our behalf, in connection with or related to the conduct or any act or omission of a Payment Processor.
Orders
The display of products on the Site shall not be deemed as an irrevocable offer to sell. The placement of an order by User shall be considered as an offer to purchase made by the User, and only actual supply of the product, subject to the existing inventory at the moment of supply, delivery coverage areas, and these Terms, shall be deemed acceptance of such offer. BiblicalProtein reserves the right to cancel purchases or not to allow a User to make a purchase, or reduce the quantity of ordered products, without explaining or provide any reasoning, at its sole discretion, including refuse to orders it may deem to be wholesale purchasing.
Delivery
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
Order Cancelation
If you wish to cancel an order we will do our best to make the cancellation prior to shipment. We are unable to cancel, revise or recall an order once it has shipped.
Return Policy
Before returning any product, please call us at +1-917-9937316 (detail days/hours) or email info@biblicalprotein.com for prior approval (RMA Number). Returns will not be accepted without prior approval.
Copyright, Trademarks and other Intellectual Property
BiblicalProtein retains all rights in the Site and materials related thereto (including, but not limited to, software, designs, graphics, texts, information, pictures, video, sound, music, and other files, their selection and arrangement and “Look and Feel”, trademarks, tradenames, service marks, branding features, business names, logos, slogans) (collectively, “Site Materials/Marks”). The contents of the Site are protected by applicable copyright, trade, patent, and trademark laws, international conventions, and other laws protecting intellectual property and related proprietary rights. You shall not, nor shall you cause or assist any other party to copy, reproduce, redistribute or create derivative works of the Site Materials/Marks, or otherwise breach such intellectual property rights of ours. BiblicalProtein and/or its licensors and affiliates own all right, title, and interest, including copyrights and other intellectual property rights, in and to all the Service Materials/Marks.
You are not required to provide BiblicalProtein with any feedback or suggestions regarding the Site or any Service Materials/Marks. However, should you provide BiblicalProtein with comments or suggestions for the modification, correction, improvement or enhancement of the Site and/or any Service Materials/Marks, then, subject to the terms and conditions of these Terms, you hereby grant BiblicalProtein a non-exclusive, irrevocable, worldwide, royalty-free license, including the right to sublicense, to use and disclose such comments and suggestions in any manner BiblicalProtein chooses and to display, perform, copy, make, use, sell, offer to sell, and otherwise dispose BiblicalProtein’s products, services and content embodying such comments or suggestions in any manner and via any media BiblicalProtein chooses, also without reference to the source of such comments or suggestions.
Limitation of Liability
Products purchased or offered (whether or not following recommendations and suggestions) through the Site are provided “on an “as-is” basis without any warranty of any kind, either express or implied, including, without limitation, implied warranties that the product will meet your requirements or expectations, or of merchantability, fitness for a particular purpose, title and non-infringement, or any warranties that arise from trade usage or custom.
To the fullest extent allowed by applicable law, under no circumstances and under no legal theory (including, without limitation, tort, contract, or otherwise) shall BiblicalProtein be liable to you or to any other person for any indirect, special, incidental, or consequential damages of any kind, including damages for lost profits or business, loss of goodwill, work stoppage, or loss of data, arising out of or in any way related to the products, or otherwise related the Site (including, but not limited to, any damages caused by or resulting from reliance on any information obtained from BiblicalProtein).
Site may be interrupted, delayed in operation, unavailable or fail to operate from time to time and we shall have no liability in connection therewith.
To the fullest extent permitted by applicable law, in no event shall the maximum aggregate liability of BiblicalProtein arising out of or in any way related to the products exceed the amount paid for such products. The foregoing shall constitute BiblicalProtein’s sole liability and obligation, regardless of the form of action, whether based on contract, tort, or any other legal or equitable theory.
The limitations set forth in this section will not limit or exclude liability for personal injury or property damage directly caused by products you purchased from us, or for our fraud, intentional, willful, or malicious misconduct.
Though BiblicalProtein maintains operational and technological measures and procedures to safeguard against unauthorized access, loss, destruction, theft, use or disclosure of the data transmitted through the Site, no method of transmission over the internet or electronic storage is 100% secure, and no assurance against cyber-attacks and vulnerabilities is provided.
Because some states and/or jurisdictions do not allow the disclaimer of certain warranties or the limitation or exclusion of liability for certain types of damages, some of the above disclaimers and limitations may not apply to you is such disclaimers are forbidden by your state/jurisdiction.
Notices and Consent to Communications
You agree that notices to you may be made via the Site and/or email and/or SMS messages. BiblicalProtein may also provide notices of changes to these Terms or other matters by displaying notices or links to notices to you generally through the Site. You agree that all agreements, notices, disclosures and any other communications that BiblicalProtein provide as aforementioned satisfy any legal requirement that such communications be in writing. If email notice is provided, not receiving notice due to an invalid e-mail address will neither release you of your obligations under these Terms, nor be deemed a valid excuse for any reason.
Account Suspension/Termination
User should acknowledge that BiblicalProtein may refuse/suspend/block/disable use of the Site or may terminate his account with or without notice for any reason, including, but not limited to, a suspected violation of these Terms applying to the Site, at its sole discretion. As a result of the account suspension/termination User may lose contents available through the Site, and BiblicalProtein shall have no responsibility for any consequence of the foregoing. If you have more than one account, BiblicalProtein may terminate all your accounts. If you believe that any such action has been taken against your account in error, please contact us at: info@biblicalprotein.com. You further agree that BiblicalProtein may take further actions as to ensure User compliance with these Terms, including, but not limited to, IP address blocking.
Force Majeure
BiblicalProtein shall not be liable for any failure due to causes beyond its reasonable control including, but not limited to, natural or artificial disaster, riot, war, strike, acts or omissions of other parties, acts or omissions of civil or military authority, government priorities, changes in law, material shortages, fire, strikes, floods, epidemics, quarantine restrictions, acts of terrorism, delays in transportation or inability to obtain labor, materials or products through its regular sources, which shall be considered as an event of force majeure excusing BiblicalProtein from performance and barring remedies for non-performance. In an event of force majeure condition, BiblicalProtein’s time for performance shall be extended for a period equal to the time lost as a consequence of the force majeure condition without subjecting BiblicalProtein to any liability or penalty. BiblicalProtein may, at its option, cancel the remaining performance, without any liability or penalty, by giving notice of such cancellation to User.

Miscellaneous
These Terms constitutes the only agreement between us and you with respect to the Site. These Terms supersedes all prior or contemporaneous agreements, representations, warranties and understandings, written or oral, with respect to the subject matter of this agreement.
If any provision of these Terms shall be held, by court of competent jurisdiction, void, unlawful, or otherwise unenforceable, that provision (only its voided/unlawful/unenforceable part, and to the minimum extent possible) will be severed from these Terms and the remainder of these Terms will remain in force.
You may not assign these Terms, by operation of law or otherwise, without our prior written consent. Subject to that restriction, these Terms will be binding on, inure to the benefit of and be enforceable against the parties and their respective successors and assigns.
The failure of BiblicalProtein to enforce any term of these Terms will not constitute a waiver of such term and will not be considered a waiver or limit BiblicalProtein’s right thereafter.
Refund Policy
Our policy lasts 14 days. If 14 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange.
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. Gift cards are non-returnable.
To complete your return, we require a receipt or proof of purchase.
Please do not send your purchase back to the manufacturer.
There are certain situations where only partial refunds are granted (if applicable)
Any item not in its original condition, is damaged or missing parts for reasons not due to our error
Any item that is returned more than 14 days after delivery
Refunds (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days. There is no need to contact the credit card company.
Late or missing refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.

Exchanges (if applicable)
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at info@biblicalprotein.com<mailto:info@biblicalprotein.com> and send your item to: Hargol FoodTech Ltd., PO BOX 104, Elifelet , Israel, 12330.
Gifts
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.
If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

To return your product, you should mail your product to:

You will be responsible for paying for your own shipping costs for returning your item, unless your product was shipped to you damaged or defective. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.
Refunds will take between 5-10 days to be processed.
